O Procuradoria Regional dos Direitos do Cidadão em São Paulo entrou com ação nesta quinta-feira (16) exigindo retratação do programa "Vitória em Cristo", da TV Bandeirantes, por comentários homofóbicos. Segundo a Procuradoria Regional dos Direitos do Cidadão em São Paulo, o pastor Silas Malafaia defendeu “baixar o porrete” e “entrar de pau” contra integrantes da Parada do Orgulho LGBT de São Paulo.

A ABGLT (Associação Brasileira de Lésbicas, Gays, Bissexuais, Travestis e Transexuais) reclamou das declarações ao MP, que abriu inquérito na procuradoria para apurar o caso. O MP pede que a retratação vá ao ar com pelo menos o dobro do tempo usado nos comentários.

“Os caras na Parada Gay ridicularizaram símbolos da Igreja Católica e ninguém fala nada. É pra Igreja Católica 'entrar de pau' em cima desses caras, sabe? 'Baixar o porrete' em cima pra esses caras aprender (sic). É uma vergonha”, disse o pastor evangélico, segundo a ação. À procuradoria, Malafaia disse que fez uma “crítica severa a determinadas atitudes de determinadas pessoas desse segmento social, acrescida também de reflexão e crítica sobre a ausência de posicionamento adequado por parte das pessoas atingidas”.

O religioso afirmou ainda que as expressões “baixar o porrete” ou “entrar de pau” significam apenas “formular críticas, tomar providências legais”.

“As palavras (...) configuram um discurso de ódio, não condizente com as funções constitucionais da comunicação social”, diz o Procurador Regional dos Direitos do Cidadão, Jefferson Aparecido Dias. Para ele, as gírias têm claro conteúdo homofóbico, por incitar a violência em relação a LGBTs.

Pressão
Durante o inquérito, o pastor pediu a seus fiéis que enviassem e-mails em sua defesa ao procurador, o que gerou centenas de e-mails ao gabinete, segundo o MP. “Da mesma forma que seus seguidores atenderam prontamente o seu apelo para o envio de tais e-mails, o que poderá acontecer se eles decidirem, literalmente, “entrar de pau” ou “baixar o porrete” em homossexuais?”, questiona o procurador.

A ação também é movida contra a Bandeirantes, já que a emissora de TV é uma concessão pública. Segundo o procurador Dias, a TV está presente em pelo menos 90,3% dos municípios brasileiros. “Trata-se de número enorme de pessoas expostas ou passíveis de exposição a manifestações de cunho homofóbico”, afirma.

Para ele, a demora judicial pode permitir que o réu continue “propagando tais mensagens, atentando continuamente contra direitos fundamentais de homossexuais”.
