A Comissão de Direitos Humanos do Senado aprovou nesta quinta-feira (24) projeto de lei que inclui no Código Civil a união estável entre pessoas do mesmo sexo e sua futura conversão em casamento. A proposta transforma em lei uma decisão já tomada por unanimidade pelo Supremo Tribunal Federal (STF) em maio de 2011, quando reconheceu a união estável homoafetiva como unidade familiar.
A proposta, da senadora Marta Suplicy (PT-SP), ainda terá que passar pela Comissão de Constituição e Justiça (CCJ) antes de ir a plenário e também terá que ser votada pela Câmara dos Deputados, onde deverá enfrentar muito mais resistência do que no Senado, especialmente por parte da chamada bancada evangélica.
Em seu relatório sobre o PL, a senadora Lídice da Mata (PSB-BA) defendeu a proposta lembrando que o Congresso está atrasado não apenas em relação ao STF, quanto em relação à Receita Federal e ao INSS, que já reconhecem casais do mesmo sexo em suas normas. A senadora lembra, no entanto, que a conversão de união estável em casamento não tem qualquer relação com o casamento religioso.
"O projeto dispõe somente sobre a união estável e o casamento civil, sem qualquer impacto sobre o casamento religioso. Dessa forma, não fere de modo algum a liberdade de organização religiosa nem a de crença de qualquer pessoa, embora garanta, por outro lado, que a fé de uns não se sobreponha à liberdade pessoal de outros", apontou em seu relatório.
Apesar da decisão do STF, que serve de jurisprudência para as demais esferas judiciais, casais homoafetivos têm tido dificuldade em obter na Justiça a conversão, mesmo em cidades grandes como São Paulo e Rio de Janeiro. Vários juízes alegam, apesar da decisão do órgão superior, que não há legislação a respeito. Durante a votação do STF, o então presidente do Tribunal, ministro Cezar Peluso, cobrou do Congresso que "assumisse a tarefa que até agora não se sentiu propensa a fazer" e transformasse a conversão em lei.

Despite the decision of the Supreme Court, which serves as a case for the other court levels, homosexual couples have had difficulty in obtaining justice in the conversion, even in big cities like Sao Paulo and Rio de Janeiro. Several judges argue, despite the decision of the superior body, there is no such legislation. During the vote on the Supreme Court, the then President of the Court, Minister Cezar Peluso, urged the Congress to "take the task that until now did not feel inclined to do" and transform the conversion into law.
