O Congresso Nacional registrou, de 1969 até o mês de novembro deste ano, 97 propostas relacionadas aos direitos de lésbicas, gays, bissexuais, travestis e transexuais, segundo mostram dados de um estudo feito pelo Núcleo de Pesquisas de Gênero da Universidade Estadual de Campinas (Unicamp). O levantamento foi encomendado pelo Ministério da Justiça.
Das 97 propostas, oito estão em andamento e visam proibir a união entre pessoas do mesmo sexo. Em maio deste ano, por falta de uma lei sobre o tema, o Supremo Tribunal Federal (STF) reconheceu a união estável homoafetiva.
Os dados do levantamento foram divulgados pelo governo brasileiro nesta sexta-feira (16) durante a 2ª Conferência Nacional de Políticas Públicas e Direitos Humanos de LGBT, que acontece até domingo (18) em Brasília.
O levantamento analisou decisões judiciais, projetos de lei e portarias do Executivo que trataram de questões relacionadas aos LGBTs. Além das 97 propostas no Congresso em pouco mais de 40 anos, no Judiciário foram identificadas 391 decisões de tribunais superiores sobre o tema, entre 1976 e 2011. No Poder Executivo, desde 1995, foram editados 54 atos normativos que tratavam de políticas públicas envolvendo LGBTs.
Conforme o estudo, há projetos que pedem que a relação entre pessoas do mesmo sexo não seja considerada como entidade familiar e que proíbem adoção de crianças por LGBTs.
Há proposições que criminalizam a discriminação em locais de trabalho e projetos que visam a educação para evitar prática de bullying.
Para a pesquisadora da Unicamp Rosa Oliveira, que coordenou o estudo feito em parceria com a Secretaria de Reforma do Judiciário, os dados mostram que o Legislativo é o poder menos atuante em relação aos direitos LGBT.
“Apesar de o Poder Legislativo ser o que menos coopera com relação aos direitos dos homossexuais, existe grande contribuição do Poder Judiciário e, a partir de 2008, do Executivo em implementar as políticas sociais nesse sentido”, afirmou Rosa Oliveira.
Para ela, um dos motivos para a postura do Congresso Nacional é o chamado “fundamentalismo religioso”.
“Existe um paredão do fundamentalismo religioso no Congresso, que se sobressai ao estado laico”, afirmou. A pesquisadora citou uma proposta de emenda à Constituição que pretende autorizar agremiações religiosas a contestar leis no Supremo. “Eles estão cercando por todos os lados e têm maioria no Legislativo”, avaliou.
O deputado federal Eduardo Cunha (PMDB-RJ), integrante da Frente Parlamentar Evangélica da Câmara, afirma que o impasse no Congresso sobre temas relacionados a LGBTs existe porque as bancadas religiosas não aceitam reconhecer a união entre pessoas do mesmo sexo como família.
“É o grande ponto de discórdia. A gente respeita, mas o único problema é que não concordamos com o reconhecimento disso como família. A sociedade não concorda e não aceita. É uma minoria querendo impor à maioria a opção deles”, disse o parlamentar.
“Por exemplo, a gente não concorda que uma criança seja criada por um casal homossexual. Isso é substituir a família”, completou. Segundo Cunha, outros projetos são desnecessários do ponto de vista dos parlamentares religiosos. É o caso da criminalização da homofobia, que segundo ele já está prevista no Código Penal.
“Não há necessidade de fazer projeto. A pena é a mesma se você agride um homossexual ou um heterossexual. Você agrediu um ser humano. O Congresso representa a sociedade, se temos número e nos articulamos, é porque a maioria do país não concorda”, afirmou Eduardo Cunha.
Executivo
O estudo também cita que, das 54 normas sobre LGBTs criadas no âmbito do Poder Executivo e de conselhos profissionais, 38 surgiram a partir de 2008. Os pesquisadores avaliam que esse incremento se deve ao estímulo dado pelo início das conferências nacionais de políticas públicas para LGBTs, como a que acontece em Brasília.
“Depois de muitos anos de mobilização social, o Estado brasileiro começa a se apropriar da produção de políticas antidiscriminatórias”, lembrou a pesquisadora.
A maioria das ações do Executivo, segundo a pesquisa, são relacionadas às áreas da saúde e assistência social.
Judiciário
Ainda de acordo com os dados, 91 das 391 decisões de tribunais superiores se referem ao reconhecimento de união estável e de direitos relacionados à vida em comum de pessoas do mesmo sexo, como o direito a pensão alimentícia, adoção, pensões e inclusão em planos de saúde.
A pesquisadora citou a decisão do Supremo Tribunal Federal que reconheceu a união estável entre casais do mesmo sexo. Na prática, as regras que valem para relações estáveis entre homens e mulheres passaram a ser aplicadas aos casais homoafetivos.
“Quem deu uma resposta de mais impacto no campo dos direitos foi o Judiciário por causa da decisão do STF. Tecnicamente, não dá para colocar um poder tão do lado do outro, porque são políticas diferentes. Mas, do ponto de vista apenas quantitativo, o Judiciário está à frente”, avalia Rosa Oliveira.
Outras 75 decisões da Justiça reconheceram os direitos LGBT à indenização por danos morais, a maioria - 51 - por preconceito no ambiente de trabalho.
Tribunal militar
Segundo a pesquisadora, no entanto, chamam a atenção 101 casos judiciais dos quais 51 criminalizaram a homossexualidade.
O motivo disso é o artigo 235 do Código Penal Militar que pune militares com detenção de 6 meses a um ano pelo crime de praticar ou permitir crime de 'pederastia'. Essa foi a primeira norma brasileira a tratar de homossexualidade. Segundo a pesquisa, entre 1976 e 1997, todas as decisões dos tribunais superiores eram relativas à 'pederastia'.
“Seria um avanço derrubar esse artigo do Código Militar que surgiu em 1969, em plena ditadura militar”, disse a pesquisadora.

The National Congress recorded from 1969 to the month of November this year, 97 proposals related to the rights of lesbians, gays, bisexuals, transvestites and transsexuals, according to show data from a study by the Center for Gender Research at the University of Campinas ( Unicamp). According to the study, there are projects that require that the relationship between same sex is not considered as a family unit and prohibiting adoptions by LGBT people.
There are propositions that criminalize discrimination in the workplace and education projects that aim to prevent bullying practice.
For the researcher from Unicamp Rosa Oliveira, who led the study in partnership with the Department of Judicial Reform, the data show that the legislative power is less active in relation to LGBT rights.
"Although the Legislature be the least cooperative relationship with gay rights, there is a large contribution of the judiciary and, from 2008, the Executive in implementing social policies accordingly," said Rosa Oliveira.
For her, one of the reasons for the attitude of Congress is the so-called "religious fundamentalism".
"There is a wall of religious fundamentalism in Congress, which stands to the lay state," he said. The researcher cited a proposed amendment to the Constitution that you want to allow religious associations to challenge laws in the Supreme. "They are surrounded on all sides and have majorities in the legislature," he said.
Congressman Eduardo Cunha (PMDB-RJ), a member of the Evangelical Parliamentary Front of the House, said the impasse in Congress on issues related to LGBT people exists because the benches do not accept religious to recognize the union between same sex as family.

Most of the actions of the Executive, the survey found, are related to the areas of health and social care.
JudiciaryAlso according to the data, 91 of 391 superior court decisions which concern the recognition of stable and rights related to the life of common people of the same sex as the right to alimony, adoption, and inclusion in pension plans health.

Military courtAccording to the researcher, however, call attention 101 court cases of which 51 have outlawed homosexuality.
