A campanha do Governo de prevenção às DST/aids neste 1° de dezembro, Dia Mundial de Luta contra a Aids, irá estimular a reflexão contra discriminação de jovens gays e pessoas vivendo com HIV e sobre a falsa impressão de que a aids afeta apenas o outro.

Desde o início do enfrentamento desta pandemia, lésbicas, gays, travestis e transexuais sofrem discriminação pelo fato de a aids ter se manifestado mais entre nós. A discriminação, em muitos casos, vem acompanhada de insultos e acusações, como a de que “gays transmitem aids”, mesmo como toda a informação disponível hoje e os dados comprovando que ao HIV atinge a homens e mulheres, independentemente de suas orientações sexuais e condições sociais ou econômicas.

Segundo o Departamento de DST, Aids e Hepatites Virais do Ministério da Saúde, esse cenário é hoje o grande desafio a ser superado para que medidas preventivas e de cuidados possam ser adotadas.

O órgão considera o preconceito uma barreira não só para a prevenção de novas infecções na população LGBT jovem, mas também para a qualidade de vida de quem vive com HIV/aids. Essas pessoas sofrem por conta da exclusão emocional, social e profissional.

Os jovens LGBTs, entre 15 e 24 anos, das classes sociais menos favorecidas economicamente será o público-alvo da campanha. Informações devem ser veiculadas na TV, rádio, internet e por meio de cartazes, folders e mobiliários urbanos.

Casal recorreu porque cartório e TJ-RS negaram pedido de casamento.

O Superior Tribunal de Justiça (STJ) reconheceu, em julgamento concluído nesta terça-feira (25), o casamento civil entre pessoas do mesmo sexo. Quatro dos cinco ministros da quarta turma do tribunal decidiram autorizar o casamento de um casal de gaúchas que vivem juntas há cinco anos e desejam mudar o estado civil.

A decisão que beneficia o casal gaúcho não pode ser aplicada a outros casos, porém abre precedente para que tribunais de instâncias inferiores ou até mesmo cartórios adotem posição semelhante.

Foi a primeira vez que o STJ admitiu o casamento igualitário. Outros casais já haviam conseguido se casar em âmbito civil em instâncias inferiores da Justiça. Neste caso, porém, o pedido chegou ao STJ porque foi rejeitado por um cartório e pelo Tribunal de Justiça do Rio Grande do Sul.

O primeiro casamento civil no país ocorreu no final de junho, quando um casal de Jacareí (SP) obteve autorização de um juiz para converter a união estável em casamento civil.

O julgamento se iniciou na semana passada, com a maioria dos votos favoráveis à causa. A sessão, no entanto, foi interrompida por um pedido de vista do ministro Marco Aurélio Buzzi, o último a proferir seu voto. Em seu voto nesta terça, ele seguiu o relator do processo, em favor do casamento.

"Não estamos meramente aplicando efeito vinculante da decisão do STF, mas sim dando a decisão um interpretação que não podemos fazer", alegou.

Pedido
O casal entrou com o pedido de casamento civil antes mesmo da decisão do Supremo Tribunal Federal, em maio deste ano, que equiparou a relação homoafetiva à união estável. A identidade de ambas não pode ser revelada porque o processo tramita em segredo de Justiça.

Elas pediram em cartório o registro do casamento e, diante da recusa, resolveram entrar na Justiça. Mas o Tribunal de Justiça do Rio Grande do Sul julgou improcedente a ação, o que levou as gaúchas a recorrerem ao STJ.

Ao reconhecer a união estável entre pessoas do mesmo sexo, em maio deste ano, o STF deixou em aberto a possibilidade de casamento, o que provocou decisões desencontradas de juízes de primeira instância.

Há diferenças entre união estável e casamento civil. A primeira acontece sem formalidades, de forma natural, a partir da convivência do casal. O segundo é um contrato jurídico-formal estabelecido entre duas pessoas.

Julgamento
Na semana passada, o relator do processo, Luis Felipe Salomão, foi favorável ao pedido das gaúchas e reconheceu que o casamento civil é a forma mais segura, segundo ele, de se garantir os direitos de uma família.

"Se é verdade que o casamento civil melhor protege a família e sendo múltiplos os arranjos familiares, não há de se discriminar qualquer família que dele optar, uma vez que as famílias constituídas por casais homossexuais possuem o mesmo núcleo axiológico das famílias formadas por casais heterossexuais", disse em seu voto.

O advogado do casal, Paulo Roberto Iotti Vecchiatt, sustentou que, no direito privado, o que não é expressamente proibido, é permitido. Ou seja, o casamento estaria autorizado porque não é proibido por lei.

Para Vecchiatti, o essencial de qualquer relação amorosa é "formar uma família conjugal, cuja base é o amor familiar". "A condição de existência do casamento civil seria a família conjugal e não a variedade de sexos", argumentou.
