Os boletins de ocorrência registrados em Pernambuco passarão a identificar casos de violência e discriminação contra lésbicas, gays, bissexuais, travestis e transexuais. Uma portaria publicada no Diário Oficial conceitua o que caracteriza homofobia e determina a inclusão do nome social, por meio do qual a vítima é conhecida, da orientação afetivo-sexual e da identidade de gênero nos BOs. O secretário-executivo de Desenvolvimento Social e Direitos Humanos, Paulo Moraes, explicou, nesta sexta (29), que a implementação da medida será acompanhada pelo Centro Estadual de Combate à Homofobia, inicialmente, na delegacia de plantão de Casa Caiada, em Olinda.

“A gente vai acompanhar mais de perto, digamos assim, para mensurar a efetividade da portaria. Vamos começar paulatinamente, primeiro nesse plantão, depois vai para a delegacia de homicídios, e assim por diante”, descreveu Moraes. A portaria, assinada em conjunto pela Assessoria do Governador e pelas secretarias de Defesa Social e de Desenvolvimento Social e Direitos Humanos, define a homofobia como “violência praticada em virtude da orientação afetivo-sexual e/ou identidade de gênero da população de Lésbicas, Gays, Bissexuais, Travestis e Transexuais”. A publicação da portaria no Diário Oficial ocorreu na última quarta (27).

O objetivo, afirmou o secretário-executivo Paulo Moraes, é ensejar uma mudança na postura do poder público em relação ao assunto. “O objetivo é começar a criar parâmetros para o Estado se mover nesse sentido. Um inquérito pode trazer uma situação de homofobia e isso abre um caminho para que, no âmbito do judiciário, o promotor possa usar essa questão e, quem sabe, pedir que um homicídio seja qualificado”, explicou. A perspectiva é criar jurisprudências para que a homofobia seja um qualificador que traga penas mais severas para quem comete homicídios com essa motivação.

A portaria ainda prevê a inserção dos BOs que contenham alguma referência à homofobia no Sistema de Informações Policiais, vinculado à SDS. A intenção é criar um banco de dados com estatísticas oficiais a respeito de crimes com viés homofóbico, o que permite um mapeamento mais preciso das ocorrências, bem como facilita o desenvolvimento de políticas públicas específicas voltadas para a questão.

“É uma conquista com certeza, é sempre um ganho. Trata-se de uma pauta que a gente está pleiteando há muito tempo, mas que chega com muito atraso. Só nesse ano, já foram mais de 40 assassinatos de homossexuais no estado”, pontuou o coordenador do Instituto Papai e integrante do Fórum LGBT de Pernambuco, Thiago Rocha. Atualmente, tramita no Congresso o Projeto de Lei 122/06, que tipifica a homofobia como crime.
